When an auto accident occurs there are some very important decisions to make with regards to fixing and or replacing your vehicle. There are advantages to having your personal insurance company repair your vehicle even when the accident was not your fault. Many people assume that the other insurance company should repair their vehicle, and this is true for the most part. However, your insurance company has subrogation rights. This means that your insurance company can require the at fault persons insurance company to repay them for money spent repairing or paying for your vehicle.
The advantage is that if the liability (who is at fault) in an accident is questionable and your insurance company fixed your vehicle, your insurance company will push to get repaid (subrogation rights) by the other party thus pushing the other insurance company to admit liability. And this is especially helpful when the at fault party’s insurance company needs a little persuasion to accept liability and thus minimize their litigation costs.
